Effective July 15, 2024, employees will have only three years from the date a claim accrues to assert claims under the Kentucky Civil Rights Act and the Kentucky Wage and Hour Act, as well as claims of wrongful discharge in violation of public policy. See Kentucky HB 320. Claims filed before July 15, 2024 will continue to be subject to a five-year statute of limitations.
Representative Daniel Elliott (R-Danville) sponsored the bill to alleviate some of the administrative burden on small businesses, like retaining records and memories of events that occurred many years prior. The law also aims to make Kentucky a more competitive and attractive place for potential employers to call their home, as it will align Kentucky’s statute of limitations for employment claims with federal law and competitor states.
