In Case You Missed It: Montana Amends Its Non-Compete Ban to Include Additional Health Care Workers

Last month, Montana amended its non-compete law to provide greater freedom and mobility to a broader range of health care providers.

The amendment revises Montana state law regarding contracts that restrict the professional practices of health care providers after they leave employment, a partnership, or other form of professional relationship.  The amendment expands the list of health care providers already covered by Montana law[1] to include naturopathic physicians, registered professional nurses, advanced practice registered nurses, and physician assistants.

Under the amended law, contracts cannot prohibit these health care providers from:

  • practicing in any geographic area for any period
  • treating, advising, or consulting with former patients
  • soliciting or seeking to establish, or establishing, new patient relationships

after they leave employment, a partnership, or other form of professional relationship.

The law does not apply to contracts related to the sale or purchase of a medical practice.

The law was enacted and became effective on April 17, 2025, and applies to contracts made or renewed on or after that date.
