In Case You Missed It: Delaware Made Military Status a Protected Class

Effective July 23, 2025, Delaware amended the Delaware Code for purposes of the State’s public accommodations, housing, insurance, education, and employment laws to add “military status” as a protected class.

“Military status” means status as any of the following:

  • A member of the uniformed forces (meaning the United States Army, Navy, Marine Corps, Air Force, Space Force, and Coast Guard) or a reserve component thereof
  • A veteran, meaning a person who served in the active military, naval, air, or space service, and who was discharged or released therefrom under conditions other than dishonorable
  • A dependent of a servicemember (a member of the uniformed forces)

Delaware employers:  Update your anti-discrimination policies and practices to address military status and train personnel on the amended laws.
