Oregon Expands Its Protections Against Age Discrimination

Oregon House Bill 3187 expands Oregon’s protections against age discrimination by prohibiting certain age-related inquiries prior to an initial interview.

Effective on September 27, 2025 (90 days after adjournment of the 2025 legislative session), Oregon employers, prospective employers, and employment agencies may not request the following information prior to completing an initial interview (or, if no interview occurs, prior to extending a conditional job offer):

  • the applicant’s age
  • the applicant’s date of birth
  • dates of graduation from or attendance at an educational institution

However, age-related inquiries are allowed if:

  • the employer needs the information to confirm that the applicant meets a bona fide occupational qualification
  • federal, state, or local law requires disclosure

To further protect against age discrimination, House Bill 3187 repeals a law that allowed apprenticeship programs to exclude applicants if they were unable to complete training before age 70.

Oregon Employers:  It’s time to review and revise your employment applications to remove any questions that seek age-related information.  In addition, train your interviewers to avoid asking age-related questions.
