In Case You Missed It: Illinois Amended its One Day Rest in Seven Act to Prohibit Retaliation

Back in 2023, Illinois enacted the One Day Rest in Seven Act (Act), which generally requires employers to provide employees with at least 24 consecutive hours of rest in every seven-day period.  See our article here about the Act.

Effective March 21, 2025, Illinois amended the Act to prohibit employers from retaliating against employees who exercise their rights under the Act, make complaints to the employer or the Illinois Department of Labor alleging violations of the Act, or participate in investigations or proceedings under the Act.  See Illinois Senate Bill 3180.

No private right of action exists under the Act.  Aggrieved employees may file claims with the Illinois Department of Labor, which may assess penalties and fees and which may commence a civil action or administrate proceeding against an employer for alleged violations of the Act.
