New York Expands Its Workers’ Compensation Law to Cover Mental Stress Injuries for All Workers

Effective January 1, 2025, New York State expanded its Workers’ Compensation Law to permit all workers to seek workers’ compensation benefits for a mental health injury resulting from extraordinary work-related stress.  Prior law limited workers’ compensation claims for mental health injuries to first responders who were exposed to emergencies.  New York Governor Kathy Hochul has noted that some amendments to the new law will be necessary to better define the types of mental injuries that will be covered.
