Ken Massey focuses his practice on employment litigation and arbitration, including enforcing restrictive covenants, protecting trade secrets, and defending against discrimination and other employment claims. He has experience with conducting depositions of key witnesses and managing lawyers and paralegals in international discovery initiatives. He also has extensive experience delivering positive client results through mediation.

Mr. Massey is a member of the Executive Committee of the Asian Pacific American Bar Association of Pennsylvania, for which he has served in a number of leadership roles.

Before joining Rubin Fortunato in 2010, he worked as an associate at Pepper Hamilton LLP, where he gained significant trial, arbitration, appellate, and administrative proceedings experience.

  • Toledo Mack Sales & Service, Inc. v. Mack Trucks, Inc., No. 02-cv-4373 (E.D. Pa.): Successfully defended a major truck manufacturer against antitrust and franchise claims brought by former distributors.
  • In re Suprema Securities Litigation, Nos. 02-cv-00168, 02-cv-03099 (D.N.J.): Obtained dismissal of claims against underwriters of a public offering brought by shareholders alleging federal securities law violations.
  • Medallion Prods. v. McAlister, No. 06 C 2597 (N.D. Ill.): Won summary judgment for a manufacturer of a consumer product against a former distributor for unfair competition, trade secret misappropriation, breach of contract, and fraud.
  • Raza v. Siemens Med. Solutions USA Inc., No. 06-132-JJF (D. Del.): Won motion for judgment on pleadings for a developer of health care software against an individual alleging misappropriation of trade secrets and unjust enrichment.
  • In re Milton Hershey School, 590 Pa. 35 (2006): Successfully appealed a private school's board of directors' claim rejecting standing of school alumni to intervene in school management and administration.
