Jason K. Roberts focuses his practice in the area of employment litigation with an emphasis on matters surrounding employee discipline and termination, protection of confidential information, restrictive covenants, discrimination, and harassment. Mr. Roberts has experience handling cases in the state and federal courts of New York, New Jersey and Pennsylvania as well as the Financial Industry Regulatory Authority. Mr. Roberts has conducted employment investigations for clients involving issues such as sexual harassment and employee misconduct. Mr. Roberts has also drafted and advised clients on employment policies and procedures as well as performed extensive legal research in all major areas of employment law including the ADA, FMLA, FLSA, ERISA, the ADEA and Title VII.

During law school, Mr. Roberts interned with the Civil Rights Division of the United States Department of Justice in Washington, DC as well as the Public Defender’s Office in Morristown, NJ and Harlem Legal Services in New York City. Prior to joining Rubin Fortunato, Mr. Roberts gained experience as an associate in the Labor and Employment department of a prominent New Jersey based law firm.

  • Merrill Lynch, Pierce, Fenner & Smith Inc. v. Annie Li, FINRA Dispute Resolution, No. 09-00408, San Francisco, California (2010): Counsel, obtained successful verdict on breach of contract claim, respondent's affirmative defense of discrimination denied.
  • Merrill Lynch, Pierce, Fenner & Smith Inc. v. Steven Mandala, FINRA Dispute Resolution, No. 09-04453, New York, New York (2011): Counsel, obtained successful verdict on breach of contract claim, including full amount owed on an outstanding promissory note, plus interest and attorney's fees.
